Terms of Use & Data Protection Charter
Our personal data protection policy is designed to build a relationship of trust between you and our services, so that you enjoy a positive and fully transparent experience.
At NAQA, protecting your personal data and our customers' privacy ("your data") is a priority. To make sure you can use our website naqaa-shop.com and any related versions or applications (the "Site") safely, we explain below how we process your data, so that our services always respect your rights.
We take every precaution needed to protect your data against disclosure, loss or alteration, and we keep it only for as long as necessary. You can access and change your data at any time. We are committed to complying with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
1. Who are you?
When we say "you" in this charter, we mean you as a NAQA customer if you have placed an order on the Site, as a registered customer if you have created an account without ordering, or as a visitor if you have browsed the Site without creating an account or ordering.
2. Why do we process your data?
2.1. When do we collect your data? Your personal data may be collected when you visit the Site (through cookies), create a customer account, order one of our products or sign up to our newsletters (SMS, emails). We use it to make your browsing smoother and more personal, process your orders, prevent fraud, issue refunds and manage customer reviews.
2.2. Browsing the Site. We process your data to let you browse the Site, on the legal basis of your consent.
2.3. Processing your orders. We use your data to handle and process your orders, customer relations (including through social media), after-sales service, distance selling, marketing, and the management, delivery and transport of orders. The legal basis is the performance of the contract between us. Product recalls are handled under our legal obligations. Marketing is based, depending on the case, on your consent or on our legitimate interest.
2.4. Instalment payments. Where pay-in-instalments options (such as Klarna) are offered, we may share your contact details and order details with the provider so it can check your eligibility. Your data is then processed under that provider's privacy policy.
2.5. Customer reviews. To let you leave a review and share reviews with other customers and visitors, we use your data on the basis of your consent or our legitimate interest.
2.6. Payment collection and fraud prevention. We use your data to collect payments, prevent fraud and keep payments secure, on the basis of the contract between us and our legitimate interest.
2.7. Advertising. We use your data to manage our advertising: building our customer and prospect lists, commercial statistics, analysis of advertising campaigns and promotional operations. The legal basis is your consent or our legitimate interest.
3. Where does your data go?
Your data is shared with our internal teams. It is not sent to third parties, except to service providers that help us process your orders (payment, customer service, after-sales, delivery, IT, website management, insurance), payment providers for instalment payments, our review management provider, and, for advertising, our advertising partners.
4. How long do we keep your data?
We keep your data only as long as necessary for the purposes described in section 2:
- prospects: 3 years from the last contact;
- customers and orders: 5 years from the end of the commercial relationship, then archived for as long as required by our legal, accounting and tax obligations;
- card details: for the period of validity of the card only.
Cookies and how long they last are described in section 6.
5. Your rights
- 5.1. You have the right to access, change and correct your data.
- 5.2. You have the right to ask us to restrict the processing of your data, for example while we check its accuracy, or if you believe our use is unlawful but prefer restriction to erasure.
- 5.3. You have the right to ask us to delete your data. We may still keep it in an archive for as long as needed to meet our legal, accounting and tax obligations.
- 5.4. You have the right to object to the use of your data for marketing. You can unsubscribe from our emails at any time using the "unsubscribe" link in every newsletter, or via our contact page. For SMS, reply STOP.
- 5.5. You have the right to data portability.
- 5.6. You have the right to withdraw your consent at any time. This does not affect the lawfulness of processing carried out before you withdrew it.
- 5.7. You have the right to complain to the Information Commissioner's Office (ICO): ico.org.uk.
To exercise your rights, email contact@naqaa-shop.com with your name and email address. We will reply within one (1) month.
6. Cookies
6.1. What is a cookie? When you browse a website such as ours, a small text file called a cookie may be stored on your device (computer, phone or tablet) through your browser, depending on your choices. It lets the website recognise your device on your next visit, for the cookie's period of validity. Only the issuer of a cookie can read or change the information it contains.
6.2. What do we use cookies for?
- Essential cookies are needed to use the Site, for example to place an order. Without them you may have trouble browsing the Site or be unable to order.
- Analytics and personalisation cookies are optional. They help us make your searches easier, improve your experience, better understand your expectations and adapt our offers and the Site.
- Advertising cookies are optional. They help show you offers and adverts that are relevant to your interests, based on your recent browsing.
- Third-party and social media cookies: some third parties (for example social networks, through "share" or "like" buttons) may set their own cookies under their own privacy policies. We do not control how they use them. Please check the privacy policies of the social networks you use (for example Meta).
Non-essential cookies are only used with your consent, which you can change at any time.
6.3. Your browser settings. You can set your browser to accept or refuse cookies, to ask you each time, or to delete cookies already stored. Refusing some cookies may affect how the Site works (for example, placing an order). See your browser's help menu: Chrome, Safari, Firefox, Edge.
7. Transfers outside the UK
Some of our service providers are located outside the United Kingdom. In that case, we make sure the transfer complies with data protection law and that your privacy and fundamental rights are protected (for example through standard contractual clauses or the UK International Data Transfer Agreement). You can ask us for more information.
8. Security
We take technical and organisational measures to ensure a level of security appropriate to the risks to your rights and freedoms, and we follow the Payment Card Industry Data Security Standard (PCI DSS).
9. Automated decisions
Some payment options (such as paying in instalments) may involve an automated risk assessment based on the products ordered or the customer profile. If the risk of fraud or non-payment is considered too high, that option will not be offered. You can ask for a human review, give your point of view and contest the decision.
10. Updates
We update this charter whenever necessary to keep it in line with data protection law.
